Terms and Conditions

The terms that apply when you book leak detection with us. Your rights under the Australian Consumer Law are not affected.

1. Interpretation

In these terms and conditions:

  • "Company", "we", "us" and "our" means Plumbed Right Pty Ltd (ABN 48 145 689 907) trading as Leak Detection and Pipe Repairs Perth, holder of Plumbing Contractor's Licence PL7390 · Gasfitting Permit GF13592, and its successors and assigns.
  • "Customer", "you" and "your" means the person or entity who books our Services, or on whose behalf the Services are booked, and their successors and assigns.
  • "Services" means the leak detection and investigation services we supply to you, including any written report, advice or recommendation that forms part of them.
  • "Quote" means the scope and fixed detection price we agree with you before work starts, whether given in writing, by SMS, by email or in our booking confirmation.
  • "Repairing Plumber" means a licensed plumber you engage separately to carry out any repair.

By booking our Services you agree to these terms. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

2. Our services and scope

We provide non-destructive water leak detection across the Perth metropolitan area and the Peel region, using methods such as acoustic correlation, FLIR thermal imaging, pipe locating and hydrogen-nitrogen tracer gas. Tracer gas is a method we use to find water leaks.

We are a detection service. We do not carry out the repair. Any repair is carried out by a Repairing Plumber you engage separately (often Plumbed Right), under that plumber's own quote and terms and conditions. We can help coordinate that plumber, but the repair is a separate contract between you and the Repairing Plumber.

We do not carry out gas leak detection ourselves. Where a gas leak investigation is needed, it is subcontracted to an appropriately licensed gasfitter and quoted separately.

3. Bookings and hours

You can book by phone, by email or through our website. Our hours are Monday to Saturday, 6am - 8pm. Outside hours, our phone line takes your booking and a plumber triages it. We confirm a visit time once we have enough information to schedule it.

Attendance times are confirmed at booking and depend on availability. We do not provide an after-hours service and we do not guarantee a response or attendance time.

4. Pricing and quotes

We agree the scope and a fixed detection price with you before work starts. Prices are in Australian dollars. As a guide:

  • Outdoor hot and cold water leak detection starts at $895.
  • Pool leak detection ranges from $1,300 to $1,700, depending on pool size, access and the agreed testing scope.
  • Iplex pipe investigation is $495.
  • Travel is charged at $50 per 25km beyond inner-metro Perth.

Outdoor hot and cold water leak detection starts at $895. Once we agree your scope and fixed price, extra time spent finding that leak does not increase your detection fee, even if it takes six hours.

GST and estimates: all prices include GST. Advertised prices are estimates. We confirm your price for your property before work starts, and site conditions such as access, depth, ground conditions or the pipework we find can change it. If the price needs to change, we tell you and agree the new price with you before we continue.

Repairs are not included in the detection price. Any repair is quoted separately by the Repairing Plumber.

Errors: we may occasionally make an error or omission in a Quote or invoice. We may correct it, and we will tell you. If a correction would increase the price you agreed, we will not proceed on the corrected price without your agreement, and you may cancel the affected work without a cancellation fee.

5. No find, no fee

For an eligible outdoor leak, we find the leak within the agreed scope or you do not pay the detection fee. A minimum leak flow is required. We confirm the flow requirement and your eligibility before you book; low-flow and intermittent leaks need separate assessment.

Whether a leak is eligible, and the agreed scope, are confirmed with you before you book. Travel and any separately agreed work outside the agreed scope are charged as stated in your Quote.

6. Changes to the scope of work

Scope changes: any change or addition to the agreed scope that you request must be agreed by us. If we agree, we will give you a new or amended Quote showing any change in price or timing before we proceed.

Unforeseen conditions: if we find conditions on site that we could not reasonably have known about (such as hidden obstructions or safety risks), we will explain them to you. Any increase in price must be agreed by you before we continue.

Leaks outside your property: if we locate the leak in Water Corporation infrastructure, a public main or another property, our detection is complete and the agreed detection price is payable. Any further action with the Water Corporation or the owner of that infrastructure is your responsibility, and we are not responsible for infrastructure beyond your property boundary.

7. Underground services and site hazards

Before we start, please tell us about any underground or hidden services and hazards you know of at the site (for example gas lines, water pipes and electrical cables).

Except to the extent caused by our negligence, we are not liable for damage to services or hazards that were not disclosed to us and that we could not reasonably have identified.

8. Access and site preparation

Site readiness: you must give us safe and reasonable access to the property and to the suspected leak area at the booked time.

Delays: if access is obstructed or the site is unsafe, we may delay the Services until the issue is resolved, and we may charge for lost time or costs incurred as stated in your Quote.

Authority: you confirm that you own the property or have the owner's authority to engage us. We may ask for the owner's written authority before we start.

Non-destructive work: we will not cut concrete, remove tiles, lift floorboards or carry out any other destructive work without your written agreement.

9. Compliance with laws and standards

You are responsible for the existing plumbing, electrical, gas and other systems at the site. If we find a system that is unsafe or non-compliant, we may stop work until it is made safe. Any work needed to bring the site into compliance is not part of our Services and is at your cost.

10. Reports, Water Corporation and insurance

Reports: we provide a written report of our findings, which may include photos, the leak location and our recommendations.

Water Corporation leak allowance: we can assist you with your Water Corporation leak allowance application by providing information and our report. We do not lodge the application for you. The decision to grant an allowance, and the amount, rests with the Water Corporation, and we cannot guarantee approval.

Insurance: we provide our report for you to give to your insurer. The outcome of any insurance claim is a matter between you and your insurer, and we do not guarantee that a claim will be accepted.

11. Raising a concern about our work or invoice

If you have a concern about our Services or an invoice, please tell us in writing as soon as possible, ideally within 7 days of the Services or 14 days of the invoice date, so we can look into it while the details are fresh.

These timeframes are a request to help us resolve things quickly. They do not limit your rights under the Australian Consumer Law.

12. Consumer guarantees and warranties

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. If a failure with the service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to cancel the contract and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the service.

Repairs: because we do not carry out repairs, any warranty on a repair is given by the Repairing Plumber under its own terms.

Exclusions: except as required by the Australian Consumer Law, we are not responsible for problems caused by work, alterations or interference by you or third parties after we leave site, or for new leaks unrelated to the leak we were engaged to find.

13. Cancellations

You may cancel or reschedule a booking with more than 24 hours' notice at no cost.

If you cancel with less than 24 hours' notice, a cancellation fee of $297 (including GST) applies to cover preparation and travel costs.

If we cannot attend as booked, we will reschedule at no cost to you.

14. Payment

Payment terms: you agree to pay the amount due by the due date shown on your invoice, using a payment method we accept.

Failure to pay: if you do not pay by the due date, we may:

  • Charge a late payment fee of $50
  • Charge interest on the overdue amount at 15% per year, calculated daily from the due date until paid
  • Withhold further Services until the account is paid
  • Take legal action to recover the amount owing
  • Refer the account to a debt collection agency and recover the reasonable collection and legal costs we incur

Joint and several liability: if more than one person or entity enters into this agreement, each is jointly and severally liable for any amount due.

15. Limitation of liability

To the maximum extent permitted by law, and subject to section 12:

  • We are not liable for indirect or consequential loss, including loss of profits, loss of rent or business interruption, or for damage caused by leaks we were not engaged to find.

Nothing in these terms excludes any consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law.

16. Whole agreement

These terms, together with your Quote and booking confirmation, make up the whole agreement between us for the Services. If your Quote and these terms conflict, your Quote applies.

17. Changes to these terms

We may update these terms from time to time. The terms in force on the date of your booking apply to that booking. Clerical errors may be corrected without notice. The "Last updated" date at the top of this page shows when this version was issued.

18. Severance and waiver

If any provision of these terms is invalid or unenforceable, the remaining provisions are not affected. A failure or delay by either party to exercise a right is not a waiver of that right.

19. Dispute resolution

Notification: if a dispute arises, please notify us in writing and we will both try to resolve it in good faith through negotiation.

Mediation: if the dispute is not resolved within 14 days, either party may refer it to mediation with a mutually agreed mediator.

Other options: if mediation does not resolve the dispute, either party may pursue arbitration or legal action. Nothing in this section stops you contacting Consumer Protection WA or exercising your rights under the Australian Consumer Law at any time.

20. Governing law

These terms are governed by the laws of Western Australia, and the parties submit to the non-exclusive jurisdiction of its courts.

21. Photos

We may take photos or videos of the work for your report, training and quality assurance, and marketing. Where reasonable we avoid identifying details of you, your family or the inside of your home. If you do not want photos used in external marketing, tell us at the time of the visit.

22. Privacy and confidentiality

We handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. Both parties agree to keep confidential any information disclosed in confidence, unless disclosure is required by law.
